Lawyers at Work reveals what it means and what it takes to be a satisfied, sane, and successful lawyer in today’s tough legal marketplace. Through incisive in-depth interviews, a top legal headhunter gives the 3rd degree to 15 successful lawyers who run the gamut of the legal profession.

Practice areas represented in these profiles range from employment discrimination to corporate defense, from federal white collar prosecution to the legal structuring of complex derivative instruments, from antitrust in DC to trusts & estates in Florida, from divorce in New York to international mergers in Paris, from intellectual property in Silicon Valley to creeping expropriation in India, and from entertainment law in Hollywood to welfare rights in the Bronx. Law firm sizes range from one of the biggest in the world with over two thousand lawyers to a one-lawyer general practice. Career levels range from biglaw partners and courtroom superstars to mid-level associates and ex-lawyers.

Mesothelioma Law Firm

What is Mesothelioma?
Mesothelioma is a rare form of cancer that occurs in the mesothelium –– a thin layer of tissue that covers most of our internal organs. In most cases, the tissue surrounding the lungs is affected. However, cases have been reported in which other body organs are affected with this condition. This form of cancer is very aggressive and oftenKnow the Risk Factors
Although several materials can possibly cause this disease, mesothelioma is primarily attributed to exposure to asbestos as reported by the Agency for Toxic Substances and Disease Registry of the CDC. Furthermore, Asbestos has been classified by the US Environmental Protection Agency (EPA) as a human carcinogen.
According to the CDC (Center for Disease Control and Prevention), exposure to asbestos increases the risk of developing malignant Mesothelioma. The latency period for the disease is reported to be around 20 to 40 years. So exposure to asbestos can go unnoticed for decades. Hence, mesothelioma cases are diagnosed years after the first exposure to asbestos occurs. In a study conducted by the CDC's National Institute for Occupational Safety and Health (NIOSH), annual multiple-cause-of-death records were analyzed for the period from 1999 to 2005. It was found that a total of 18,068 deaths were reported because of malignant Mesothelioma.
Who should be concerned?
Asbestos is imported into the United States and was even mined in the country during the 20th century. In the US, the use of asbestos peaked in 1973 when it amounted to 803,000 metric tons before declining to 1,700 metric tons in 2007. Industrial workers employed in settings such as manufacturing, construction and shipbuilding prior to 1980s are the ones who are at most risk, as federal safety regulation was not in place at the that time. Exposure continues to occur today because of the demolition of buildings in which asbestos was used during construction.
Steps to Take in Case Of Asbestos-Exposure Related Mesothelioma
After taking into consideration several research findings, exposure to asbestos has been singled out as the main cause of Mesothelioma in most cases. This exposure affects individuals differently. Several factors are involved, including concentration, frequency and duration of exposure as well as the shape, size and chemical makeup of the fibers that determine your chances of contracting Mesothelioma.
It is natural to feel concerned about Mesothelioma if you have experienced chronic exposure to asbestos. Doctors recommend that such people should get regular CT scans or chest x-rays. They must also get lung function tests as these tests can detect problems caused by asbestos fibers. If any problems are detected, you should obtain a professional Mesothelioma diagnosis. In the unfortunate event of being diagnosed with Mesothelioma, you have the grounds for filing a lawsuit. A Mesothelioma law suit can help you claim compensation for the additional costs borne in dealing with this disease as well as for the resulting emotional distress and trauma.
Why choose a Mesothelioma Law firm
The dangers associated with asbestos exposure have been known to the Asbestos manufacturers for decades. Victims of the disease rightly feel that they should have been warned about these dangers and so undue hardships both for the victims and their families could have been avoided. Treatment plans are often tailored to the patient’s needs so the medical expenses incurred because of the disease vary from person to person and are often considerable.
If you feel that you or a loved one has developed mesothelioma and have also been exposed to asbestos fibers during their lives, you will typically be eligible for filing a lawsuit and claim compensation for any treatment related expenses, as well as for the pain and suffering caused by this disease. The litigation process involved is quite complex. So it is better to hire the services of a Mesothelioma law firm that has the time as well as the resources to tackle investigations specific to your case.

Asbestos Attorney

What is Asbestos?
Asbestos is the name given to a type of mineral fiber that is found in rock and soil. Due to the strength and heat resistance of the fiber, it has long been used in buildings for insulation and as a fire-proofing construction material. In addition, asbestos is also widely used in many manufactured and pre-fabricated products. These include building materials like ceilings and floor tiles, automobile clutch and brake, heat-resistant fabrics, gaskets, packaging, and coatings. How asbestos exposure can occur?
You may be exposed to asbestos if asbestos-containing materials are disturbed or damaged in any way, causing fibers to release into the air. Situations in which exposure is likely to occur include product use, demolition work, construction or building and home maintenance and repair. According to the World health Organization (WHO), around 125 million people in the world today are exposed to Asbestos at their workplace.
What Asbestos exposure may cause?
There are a number of harmful health-related effects that have been associated with the exposure to Asbestos.
Asbestos Lung Cancer
According to the United States government’s Environmental Protection Agency (EPA), those who are exposed to the asbestos fibers face a higher risk of developing a lung disease. This has been demonstrated through several occupational studies. When the fibers are inhaled, they get trapped by the lungs and cause problems. The risk is particularly of a greater degree for smokers.
Gastrointestinal Cancer
The EPA has also identified gastrointestinal cancers as possibly resulting from asbestos exposure. The substance has thus been classified under Group A that contains know human carcinogens.
Mesothelioma
It is a rare type of cancer that usually occurs in the thin lining of the heart, lung, chest and the abdomen. According to the EPA, findings borne out from numerous occupational studies have revealed that asbestos exposure can lead to mesothelioma.
Asbestosis
It is a severe non-cancer disease of the lungs. Asbestosis is a long term condition that may adversely impact the respiratory function of those that have been exposed. It is usually identified by shortness of breath and persistent coughing.
Has the use of Asbestos been banned?
Production, import, distribution, processing and the use of most types of asbestos containing products such as roof coatings, clothing, cement flat sheet, millboard and brake blocks is legally permitted. There are however a few uses that have been banned by regulation such as the Toxic Substances Control Act (TSCA), Clean Air Act (CAA) and Consumer Product Safety Act. Examples of banned uses include corrugated and commercial paper, asbestos blocks and the use of the fibers in wall-patching compounds and artificial fireplace embers.
Asbestos Cancer Statistics
WHO estimates suggest that in 2004, asbestos-related diseases such as lung cancer, mesothelioma and asbestosis from occupational exposures led to 107,000 deaths and 1,523,000 Disability Adjusted Life Years (DALYs)
Typically, the greater the level of exposure, the greater will be the probability of developing a harmful health condition. Other factors that determine whether somebody develops a disease include the duration of exposure, the shape and size of the asbestos fibers, source of exposure and chemical composition of the fiber. Symptoms may develop years after the exposure to Asbestos. Since asbestos-related conditions are not easy to identify, physicians usually investigate into the likelihood of the fiber exposure if someone comes to them with a related problem such as lung cancer. In addition to examining the medical history, they also look at the patient’s work, cultural and environmental history.
Are you entitled to compensation?
If you, a loved one or somebody you know has developed a harmful health-related condition due to exposure to asbestos, you should promptly consult an Asbestos attorney. The lawyer will be in a better position to inform you of your legal rights and assist you in filing a lawsuit against the manufacturer of the asbestos-containing products.

Mesh Recall

The first ever Transvaginal mesh called ProtoGen, which was manufactured in 1996 by Boston Scientific, was recalled in 1999 owing to safety concerns and reports of adverse events. After a year of ProtoGen being released into the market, other companies started manufacturing mesh products and passed the clearance requirements by relying on section 510(k) that is part of the Food, Drug and Cosmetic Act. The 510(k) system simply allows a product into the market if it is similar to an already approved product.
However, during more recent times, there has been an increased concern regarding the complications associated with the placement of the surgical mesh. Taking into account the above-mentioned complications, Public Citizen, a consumer advocacy group has sent a petition to FDA to recall all Transvaginal Mesh products from the market.
Why the Transvaginal Mesh Recall Happened
Whereas, around only 1000 adverse cases associated with Transvaginal mesh devices were reported to the Food and Drug Administration (FDA) during 2005 to 2008, the number of adverse cases reports went up by 2,874 during the next three years (2008 to 2010). Of the total cases, 1,503 reports were of Pelvic Organ Prolapse (POP) patients and 1,371 cases were related to Stress Urinary Incontinence (SUI) repairs.
The most widely reported problems to the FDA included mesh erosion through the vagina (also termed as exposure, extrusion or protrusion). It can be very painful for some women and may require multiple surgeries. In some extreme cases, even multiple surgeries may fail. Other complications that were reported included pain, infection, bleeding, painful intercourse, organ perforation, and urinary problems. There were also reports about side effects such as recurrent prolapse, neuro-muscular problems, vaginal scarring or shrinkage, and emotional problems. These complications may require medical or surgical treatment and hospitalization.
Dr. Michael Carome, the deputy director of Public Citizen’s Health Research Group asserted that, “Surgical mesh in POP treatment procedures needlessly exposes patients to a wide array of serious risks, many of which can permanently alter women’s quality of life.” According to the Group, future versions of the product should be classified as ‘class III’ or higher risk medical device and should undergo more rigid approval standards like human testing to ensure that the product is safe before it is marketed for clinical use.
To make a stronger case for mesh recall, officials at Public Citizen claimed that even the FDA is doubtful about the usefulness of the surgical mesh. A review of scientific literature published during 1996 to 2011 by FDA indicated that Transvaginal POP repair with mesh does not enhance symptomatic results, meaning that it doesn’t address the symptoms of POP, or the quality of life as compared to the traditional non-mesh repair.
Therefore, if you’ve developed a complication due to the placement of the mesh, you need to be well informed about your legal rights and options.
Are you eligible to file a lawsuit?
If you or somebody who you know develops a complication due to the placement of a surgical mesh, you should consult a law firm that handles mesh related lawsuits. The lawyers will inform you about your legal rights and options and depending on your case, and help you in filing a lawsuit. You may be eligible to claim financial compensation for the expenses incurred/to be incurred in treatment as well as against the pain and suffering borne.
